Information we gather

WHEN YOU VISIT DEMOCRACY WORKS’S SITE

Democracy Works uses Google Analytics and Squarespace Analytics to monitor user traffic and visitor trends on the Site. When you visit the Democracy Works website, we record basic information such as your IP address, referral source, browser type, and the date and time of your visit. We use this data only on an aggregate basis – for example, to know which pages are most popular or how many people visit the site on a given day. This information helps us improve the Democracy Works site and our services. We do not link this information to your identity.


WHEN YOU SUBMIT A CONTACT REQUEST VIA OUR FORM

When you fill out the Contact Us form, Squarespace generates an email to one of our organizational email accounts based on your request. That email includes only the information that you provide, and we use that information only to respond to your request. Filling out this form will share your contact information with both Democracy Works and Squarespace.

COOKIES

Cookies are small pieces of data stored on your computer for a prolonged period of time that save your status and preferences. Although we make good faith efforts to store information securely, we cannot guarantee complete security. Democracy Works shall not be responsible for any harm that you or any person may suffer as a result of a breach of confidentiality of any information you transmit to the Democracy Works site.

Children’s Privacy

Democracy Works’s site is intended for voting-age adults and we do not knowingly collect personal information from children under 13 years of age. Welcome to the Democracy Works organizational site, a project of Democracy Works, Inc. This site exists to provide information about our organization and allow members of the public to contact our staff (the “Services”) through our website available at https://democracy.works (the “Site”).

USE DEMOCRACY WORKS LEGALLY

You acknowledge that information you provide will be used by Democracy Works to respond to inquiries and engage with the public on the topic of its work. You agree that you will not use Democracy Works’s information or services as part of an attempt to register to vote falsely, register to vote more than once, register to vote when you are not eligible, request more than one absentee ballot, request an absentee ballot when you are not eligible, commit any other type of election fraud, or violate any other federal, state, or local laws.

Access to and use of the site

ACTS AGAINST THE SITE/SERVICES

You shall not attempt or engage in potentially harmful acts that are directed against the Site or Services including, without limitation, the following:

  • Violations of system or network security may result in civil or criminal liability. You agree that it is your responsibility to install anti-virus software and related protections against viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines or engines that are intended to damage, destroy, disrupt, or otherwise impair a computer’s functionality or operation.

PARENTAL NOTICE

Section 230(d) as amended, Democracy Works hereby notifies you that parental control protections (such as computer hardware, software, or filter services) are commercially available that may assist you in limiting access to material that is harmful to minors. INFORMATION YOU PROVIDE

Information you provide to the Site, including your name, email addresses, and other identifying information, should be relevant to the subject scope of your inquiry to Democracy Works. USER REPRESENTATIONS AND WARRANTIES

INDEMNITIES

You agree to defend, indemnify, hold harmless, and defend Democracy Works and its licensors, suppliers, officers, directors, employees, agents, affiliates, subsidiaries (collectively “Indemnified Parties”) from and against any and all liability, loss, claim, damages, expense, or cost (including but not limited to attorneys’ fees), incurred by or made against the Indemnified Parties in connection with any claim arising from or related to your use of the Site, the placement, posting or transmission of any messages, information, software, content or other materials on or through the Site by you or users of your account, or any breach or violation of these Terms of Use by you or users of your account. You agree to fully cooperate as reasonably required by any Indemnified Party(ies). Each Indemnified Party may, at its own expense, assume the exclusive defense and control of any matter for which it is indemnified hereunder. You shall not settle any matter without the consent of the applicable Indemnified Party.

MODIFICATIONS

Democracy Works reserves the right to change, at any time, at our sole discretion, the Terms under which these Services are offered. You are responsible for regularly reviewing the Terms. Your continued use of the Site and Services constitutes your agreement to all such Terms.

TERMINATION OF SERVICE

Democracy Works disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Services or Site, or any software provided through the Site. Democracy Works reserves the right to modify, suspend, or discontinue the Services or access to the Site without any notice at any time and without any liability to you.

SCOPE OF TERMS

The Terms apply to use of and contribution to the Site and any information provided therefore. Democracy Works, Inc. may operate additional projects or services which require separate or additional terms. Such different terms are made available through the individual project or service and are not addressed further herein.

NO WAIVER OF TERMS

Failure of Democracy Works to exercise or enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision in that or any other instance.

GOVERNING LAW AND ENTIRE AGREEMENT

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to the rules of conflict of law that may cause the laws of another jurisdiction to apply. You agree to the sole and exclusive jurisdiction and venue of the federal or state courts serving Middlesex County in the Commonwealth of Massachusetts in the event of any dispute of any kind arising from or relating to the Site or Services, or your use or review of it. The Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms to be unenforceable, the remainder of the Terms will continue in full force and effect.
